HARTWORX HVAC TERMS OF SERVICE & SMS TEXTING POLICY

Welcome to Hartworx HVAC. Please read these Terms of Service carefully before utilizing our HVAC services or enrolling in our text messaging program. By scheduling service with us, signing a contract, or opting into our text program, you agree to be bound by these terms.
1. Scope of HVAC Services & Scheduling
General Estimates: All written estimates for HVAC installation, repair, or maintenance are valid for thirty (30) days from the date of issue.
Access to Property: The customer must ensure clear, safe, and unobstructed access to all HVAC equipment, basements, crawlspaces, attics, or roofs where service is to be performed.
Permits and Approvals: Unless explicitly stated in writing, Hartworx HVAC will secure necessary local building permits, but the customer is responsible for ensuring compliance with any specific Homeowners Association (HOA) or co-op rules.
2. SMS/Text Messaging Program Description
Hartworx HVAC operates a mobile text messaging program to communicate with our customers regarding scheduling, service, and updates.
Types of Messages: You may receive appointment confirmations, technician dispatch alerts (e.g., "Our technician is on the way"), service reminders, maintenance updates, billing/invoice links, and occasional promotional or seasonal HVAC offers.
How to Opt-In: You consent to receive automated text messages by providing your mobile number to us via our online contact forms, booking software, or customer intake paperwork, and actively checking the opt-in consent box.
No Condition of Purchase: Consent to receive marketing or promotional text messages is completely voluntary and is not a condition of purchasing any HVAC equipment, parts, or repair services from us.
3. Message Frequency, Costs, and Carriers
Frequency: The number of text messages you receive will vary depending on your active service requests, system installations, or ongoing maintenance agreements.
Rates: Message and data rates may apply. Check with your wireless provider for details on your text messaging plan.
Carriers: Supported mobile carriers are not liable for delayed or undelivered messages.
4. How to Opt-Out (STOP) or Get Help (HELP)
To Stop Messages: You can cancel the SMS service at any time. Text the keyword STOP to 631-873-5844 in reply to any message. After texting STOP, you will receive one final text confirming that you have been unsubscribed. You will no longer receive text messages from us unless you choose to re-enroll.

5. Privacy Policy & Non-Disclosure of Mobile Data
Data Security: We value your privacy. Hartworx HVAC will not share, rent, or sell your mobile phone numbers, SMS opt-in data, or personal consent information to any third parties, affiliates, or partners for their marketing or promotional purposes.
6. HVAC Emergency Situations & Limitation of Liability
Not an Emergency Line: Our text messaging system is automated and intended for convenience. It is not monitored 24/7. Do not text us for life-safety or urgent property emergencies.
Weather Emergencies: In the event of an absolute HVAC emergency—such as a complete loss of heat during a freezing New York winter or a loss of air conditioning during an extreme summer heatwave—do not text. Call our office phone line directly at 631-873-5844.
Limitation of Liability: Hartworx HVAC is not liable for delayed, missed, or failed text message transmissions that result in secondary property damage (such as frozen or burst pipes, mold growth, or food spoilage).
7. Customer Duty to Notify
If you change, deactivate, or reassign your mobile phone number, you agree to notify Hartworx HVAC immediately before making the change.
If you fail to notify us and a text message is sent to a third party who was subsequently assigned your old number, you agree to indemnify, defend, and hold Hartworx HVAC harmless from any legal claims, costs, or damages brought under the Telephone Consumer Protection Act (TCPA).
8. Governing Law, Binding Arbitration, and Class Action Waiver
Governing Law: These terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to our HVAC services or our text messaging program will be settled through binding, individual arbitration rather than in a court of law.
Class Action Waiver: You and Hartworx HVAC both agree that any dispute resolution proceedings will be conducted solely on an individual basis and not in a class, consolidated, or representative action.
Time Limits: Any legal claim or arbitration demand regarding these services must be filed within one (1) year after the cause of action arises, or it is permanently barred.
